Article 1 – Scope of application

Article 2 – Orders

Article 3 – Availability of items
We have sufficient stocks that allow us to process your order in 7 days maximum. If we are unable to fulfill an order within 15 days, you will be notified by mail, email or telephone.
Article 4 – Prices
The prices indicated in Swiss francs are deemed net, excluding or including tax, depending on your customer account. The applicable VAT is Swiss VAT at 8.1% and 2.6% for products intended for agriculture. All prices may be subject to shipping costs calculated during the order process. The price is payable in full and in a single payment when ordering. All orders are invoiced in Swiss francs and payable in Swiss francs.
Article 5 – Shipping costs
Shipping costs include a contribution to preparation, packaging and postage costs. They are fixed and are calculated according to the destination of the order.
Article 6 – Payment
You have several means of payment offering maximum security guarantees.
You can pay by credit card (Carte Bleue, Visa card, Eurocard/Mastercard, American Express), by indicating either directly in the area provided for this purpose (secure entry thanks to Sum Up), the number of your card without spaces between the numbers, as well as its expiry date and the last three numbers of the cryptogram (code found on the back of your card, in the space reserved for your signature).
You can also pay by bank transfer when validating your basket, the order will be sent upon receipt of the transfer.
Article 7 – Delivery
Deliveries are made to your home. The average delivery time is 1-2 days for French-speaking Switzerland and 2 to 3 days for German-speaking Switzerland, but this is not a strict deadline and Biodynamie & Cie cannot be held liable in the event of late delivery or stock shortages.
Please note: if you choose to pay by bank transfer, the order will only be processed upon receipt of the transfer and the delivery times will be extended accordingly.
Article 8 – Right of withdrawal and product conformity
You have a right of withdrawal that can be exercised within 14 (fourteen) days following the date of receipt of the product, the exercise of this right must be the subject of an unambiguous written declaration via our contact form or by mail at your expense. From the exercise of this right of withdrawal, you will have 14 (fourteen) days to return, at your expense, the goods (in their original cellophane packaging imperatively) to the following address: Biodynamie & Cie, Route de la rameau 5, 1955 Chamoson.
In return, we undertake to reimburse you for the returned product(s) as well as the standard delivery costs (corresponding to the least expensive delivery method offered) within 14 (fourteen) days from the date on which we were informed of your decision to withdraw. It is understood that we may defer the reimbursement until we have received the products concerned or you have provided us with proof of shipment. Please note: this right of withdrawal only applies if the product is returned to us unopened (in its original cellophane packaging): your item will therefore only be refunded if it is intact and without any trace of use.
Article 9 - Product conformity
Items purchased on the https://www.biody.ch site are new and guaranteed against any defect. If an item is defective or non-compliant, we undertake to exchange or refund it, provided that it is returned to us in its original packaging within 15 days of receipt of the package to: Biodynamie & Cie, route de la rameau 5, 1955 Chamoson. In this case, the shipping costs will be refunded to you based on the rate charged and the return costs will be refunded to you upon presentation of supporting documents. In the event of a refund for an item paid by credit card, we guarantee that it will be made by transfer to your bank account within 24 hours of the date of receipt of the returned package. The visuals of the books and videograms presented on the site are subject to modification and cannot under any circumstances be considered as contractual elements.
Article 10 – Internet customer account
To place an order via the website https://www.biody.ch, you will need to create an account that will be accessible using a username and password.
If you are a professional, you can request to transfer your account to a professional account via our contact form.
Article 11 – Private use
The videograms and books provided are, unless otherwise stated expressly stated otherwise, exclusively intended for private use within the family circle, in accordance with the provisions of the Intellectual Property Code. All other rights are reserved. The term "private use" excludes in particular any representation in public places such as clubs, video libraries, coaches, boats, bars-tabacs, hospitals, hotels, oil platforms, prisons and educational establishments... Article 12 – Transfer of ownership – Transfer of risks
BY EXPRESS AGREEMENT BETWEEN THE PARTIES, THE SELLER RESERVES OWNERSHIP OF THE GOODS SUPPLIED UNTIL THE LAST DAY OF THEIR FULL PAYMENT BY THE CUSTOMER. NOTWITHSTANDING THIS RETENTION OF OWNERSHIP, THE CUSTOMER WILL REMAIN RESPONSIBLE FOR THE GOODS UPON DELIVERY.

When you make a purchase, we only ask you for the essential information (name, first name, address, telephone number, e-mail) for quality processing and careful monitoring of your order. This data entered online is recorded on a secure server in Switzerland at Infomaniak. We undertake not to disclose it to a third party and to use it only to ensure the processing of your orders and to keep you informed of the development of our offers. Article 16 – Applicable law and legal venue
All disputes concerning the validity, execution or interpretation of these terms and conditions are subject to Swiss law. The exclusive place of jurisdiction is Sion.
Article 17 – Acceptance by the buyer
These general terms and conditions of sale and the prices are expressly approved and accepted by the Buyer, who declares and acknowledges having perfect knowledge of them, and therefore waives the right to rely on any contradictory document and, in particular, its own general terms and conditions of purchase, the act of purchase entailing acceptance of these general terms and conditions of sale. These conditions may be modified at any time without notice.
